La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. This study aimed to adapt the Flourishing Scale to a Chilean high school context and provide evidence of its validity. Data were collected from 1,348 students from three different Chilean schools. The results of confirmatory factor analysis supported a one–factor solution, multiple–group CFA supported gender invariance, and structural equation model indicated that the FS is related to positive and negative academic feelings. Overall, the evidence indicates that the Flourishing Scale adapted to the high school context is an instrument that produces (...) valid and reliable scores in our high school Chilean sample. This brief report assessed the psychometric validity and gender invariance of the School Burnout Inventory –a measure of students’ exhaustion, cynicism, and inadequacy– in a convenience sample of 972 high school Chilean students ranging between 12 and 18 years old. The results showed that: the SBI produces adequate scores in terms of reliability; two models fitted adequately fit to our sample and was invariant across gender; and the SBI scores were significantly related to other related constructs. There are several approaches to the way in which standards of proof in law should be understood. In the central article in this issue, Rodrigo Coloma suggests that they should be conceived either as thresholds either as prototypes. He also offers a taxonomy of the different uses of standards of proof, which transcends their function as error distributors. In their comments on the paper, Raymundo Gama and Claudio Agüero clarify and challenge this way of understanding standards of proof. Some (...) of their criticisms are right on target, but many others are directed more at Coloma’s theoretical presuppositions than at his substantial contributions. RESUMEN Se discuten las nociones de filosofía y espiritualidad, tratadas por M. Foucault en La hermenéutica del sujeto, que relacionan el sujeto con la verdad. Si la filosofía del conócete a ti mismo trata la relación cognoscitiva del sujeto con la verdad a la que tiene derecho, entonces la espiritualidad del cuidado de sí trata de la transformación experiencial que requiere la verdad para que el sujeto acceda a ella. Este es el contexto en el que M. Foucault se refiere (...) a M. Heidegger y J. Lacan como los autores que pensaron la relación entre el sujeto y la verdad. Se discute en ambos casos la distinción entre la filosofía y la espiritualidad: en Lacan, porque la experiencia psicoanalítica aparece como vivencia espiritual del cuidado de sí; en Heidegger, porque el Dasein y la verdad como desocultamiento muestran la filosofía como actividad espiritual por excelencia. ABSTRACT The article discusses the notions of philosophy and spirituality relating the subject to truth, as dealt with by M. Foucault in The Hermeneutics of the Subject. While the philosophy of “know thyself” deals with the cognitive relation of subjects to the truth they have a right to, the spirituality of the care of the self has to do with the experiential transformation necessary for subjects to have access to truth. It is in this context that M. Foucault refers to M. Heidegger and J. Lacan as authors who thought the relation between subject and truth. In both cases, the distinction between philosophy and spirituality is discussed: in the case of Lacan, because the psychoanalytical experience appears as a spiritual experience of the care of the self, and in that of Heidegger, because Dasein and truth as unveiling reveal philosophy to be a spiritual experience par excellence. The coronavirus disease pandemic fundamentally disrupted humans’ social life and behavior. Public health measures may have inadvertently impacted how people care for each other. This study investigated prosocial behavior, its association well-being, and predictors of prosocial behavior during the first COVID-19 pandemic lockdown and sought to understand whether region-specific differences exist. Participants from eight regions clustering multiple countries around the world responded to a cross-sectional online-survey investigating the psychological consequences of the first upsurge of lockdowns in spring 2020. Prosocial behavior (...) was reported to occur frequently. Multiple regression analyses showed that prosocial behavior was associated with better well-being consistently across regions. With regard to predictors of prosocial behavior, high levels of perceived social support were most strongly associated with prosocial behavior, followed by high levels of perceived stress, positive affect and psychological flexibility. Sociodemographic and psychosocial predictors of prosocial behavior were similar across regions. (shrink)

Ao longo da história da filosofia, John Locke tem sido frequentemente associado à tradição do liberalismo político, o que decorre, invariavelmente, de um modo peculiar de interpretação da noção de liberdade para o filósofo, que estaria estruturada em torno da ideia de não-interferência. Derivada frequentemente de propostas analíticas realizadas em um “vácuo histórico”, em que as ideias de Locke são tomadas como uma estática coleção, tal conclusão expressa uma perspectiva que não considera o caráter essencialmente discursivo da filosofia política e (...) o “campo problemático” em que os conceitos foram pensados pelo filósofo. Diante dessa perspectiva, o propósito deste artigo é o de realçar, na linguagem política utilizada pelo filósofo, os elementos contextuais que permitem a compreensão dos argumentos desenvolvidos pelo autor como parte de uma _performance_ – na acepção proposta por John Pocock –, a fim de destacar os aspectos que indicam a possibilidade de aproximação do conceito de liberdade de Locke da ideia de liberdade republicana, descrita por Philip Pettit a partir da ideia de não-dominação, sem descuidar da análise das evidências textuais que indicam a presença de argumentos na obra do autor que compõem o cerne da concepção republicana de liberdade. We define the notion of a completely determined Borel code in reverse mathematics, and consider the principle $CD - PB$, which states that every completely determined Borel set has the property of Baire. We show that this principle is strictly weaker than $AT{R_0}$. Any ω-model of $CD - PB$ must be closed under hyperarithmetic reduction, but $CD - PB$ is not a theory of hyperarithmetic analysis. We show that whenever $M \subseteq {2^\omega }$ is the second-order part of an ω-model (...) of $CD - PB$, then for every $Z \in M$, there is a $G \in M$ such that G is ${\rm{\Delta }}_1^1$-generic relative to Z. Literature reports that depressive symptoms may precede suicidal ideation. Several studies have identified social support and substance use as moderators of this relationship. However, no study has evaluated these variables together by testing how substance use can affect the moderating effect of social support in this relationship. The purpose of this article is to individually evaluate dimensions of social support (friends, family, significant others, and school) and substance use (alcohol, marijuana, and other illicit drugs), as moderators of the relationship between (...) depressive symptoms and suicidal ideation; as well as analyze the moderating role of substance use in the moderation exerted by social support in this relationship. This study, quantitative and cross-sectional, considered 775 adolescents [Average age = 15.48 (SD = 0.96), 45.9% women], from 20 randomly selected schools in Santiago de Chile. Simple moderation models were used to analyze possible moderators separately, and double moderation models were used to analyze the moderating role of substance use in the moderating effect of social support. The results show that the four dimensions of social support moderate the relationship between depressive symptomatology and suicidal ideation, showing the strongest interaction in the case of family support, followed by support of a significant person, support at school, and support of friends, in that order. On the other hand, alcohol was the only drug that moderated the relationship in question. In addition, the results show that the use of alcohol limits the moderating effect of social support in the fields of family, significant person, and school support, but not in the case of support of friends. The use of marijuana and other illicit drugs did not affect the moderating effects of social support for any of the areas evaluated. The results are discussed according to the different roles that alcohol use can play in adolescence, and how these, together with perceived social support, are related to the emergence of suicidal ideation from depressive symptoms. Amparado-se no pensamento de Hume, Deleuze, Rancière e Gallo, pretende-se mostrar que somente a experiência com o objeto pode promover a aprendizagem efetiva, violentando o pensamento para que este busque por si só seu sentido e forme sua própria (...) apreensão, e não a mera repetição de conteúdos partilhados e tidos como importantes, como temos encontrado nas escolas.The question that we develop in this study can be proposed as follows: can knowledge be transmitted in a representational way through an explanation in such a way that the one who is learning does not have an experience itself of what he is learning? Grounded on Hume, Deleuze, Rancière and Gallo, we aim to show that only the experience with the object can promote effective learning, for violating the thought to search by itself for its meaning and for its own understanding, and not for the mere repetition of contents that have been shared and taken as important, as we have seen in schools. Desde un diálogo con Axel Honneth, argumentaremos primero que la metodología de crítica social desarrollada en la República posee elementos constructivo-racionales y reconstructivo-hermenéuticos. Luego, enfatizaremos dos conceptos prefigurados en dicha obra que, mediante Hegel, yacen en el trasfondo de la Teoría crítica, a saber: holismo y patología social. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. El objetivo de este texto es ofrecer una clasificación de las visiones éticas en circulación en el debate actual capaz de identificar cuáles de ellas son compatibles o no con el concepto y las instituciones del Estado democrático de derecho. El texto parte del análisis de algunos modelos de pensamiento presentes en las visiones éticas animalista, feminista y decolonial para identificar problemas de compatibilidad y problemas de caricatura, es decir, cuáles de estas visiones desarrollan tensiones e incompatibilidades con u ofrecen (...) visiones caricaturizadas del Estado democrático de derecho. ley. A partir de estas reflexiones, el texto propone una distinción entre ética de la identidad y ética de la convivencia y esboza las líneas generales de un modelo institucional multinormativo que permita a ambas convivir democráticamente en una misma comunidad política. Suicide, as one of the leading causes of death for the adolescent population, both in Chile and globally, remains a complex and elusive phenomenon. This research studies the association between positive and negative affect in relation with suicidal ideation and suicidal attempt, given that affectivity is a fundamental basis on which people make evaluations on their satisfaction with life. First, it examines the reliability, structure, and validity of Watson’s positive and negative affect scale (PANAS) scale in a representative random sample (...) of Chilean high school students (N= 4,568). The scale evidences strong reliability coefficients and a confirmatory factor analysis, excluding one positive (excited) and one negative (nervous) item. The scale shows a satisfactory goodness of fit. Secondly, it investigates the association of PANAS positive and negative affect scores with suicidal ideation as well as reported attempt in adolescents, controlling for the potential effect of age and sex (N= 420 high school students). Low positive and high negative affect, but not sex and age, show a significant association with suicidal ideation. Suicidal ideation totally mediates the association of affect with suicide attempt, as expected. Results are discussed regarding prevention and it considers how positive and negative affect can be relevant as indicators for prevention and treatment using widely available technology. (shrink)

Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. A statement of hyperarithmetic analysis is a sentence of second order arithmetic S such that for every Y⊆ω, the minimum ω-model containing Y of RCA0 + S is HYP, the ω-model consisting of the sets hyperarithmetic in Y. We provide an example of a mathematical theorem which is a statement of hyperarithmetic analysis. This statement, that we call INDEC, is due to Jullien [13]. To the author's knowledge, no other already published, purely mathematical statement has been found with this property (...) until now. We also prove that, over RCA0, INDEC is implied by [Formula: see text] and implies ACA0, but of course, neither ACA0, nor ACA 0+ imply it. We introduce five other statements of hyperarithmetic analysis and study the relations among them. Four of them are related to finitely-terminating games. The fifth one, related to iterations of the Turing jump, is strictly weaker than all the other statements that we study in this paper, as we prove using Steel's method of forcing with tagged trees. El artículo aborda los conceptos de multiculturalidad, interculturalidad y educación intercultural, como perspectivas teóricas que permiten explicar la dinámica intercultural de la acción educativa y como desafío epistemológico de los conocimientos indígenas en la escolarización. Para ello se realiza un análisis de los elementos teóricos que sustentan estos conceptos; se problematiza la dificultad epistemológica de la educación intercultural, considerando el contexto en que se lleva a cabo, y en consecuencia, se plantea que la dinámica de estos conceptos permite la posibilidad (...) de considerar la interculturalidad tanto para la formación como para la problematización de situaciones interculturales que están en proceso de investigación. This article addresses the concepts of multiculturalism, interculturalism and intercultural education as theoretical perspectives to explain the intercultural dynamic of educational activities, and as epistemological challenges to indigenous knowledge in the school context. To examine these concepts we analyze the theoretical foundations which underlie them. We then formulate the epistemological problem of intercultural education, considering the context in which it takes place. Consequently, we argue that it is the dynamic of these concepts which makes it possible to consider interculturalism both in education and in the formulation of the questions posed by the intercultural situations under investigation. Two linear orderings are equimorphic if each can be embedded into the other. We prove that every hyperarithmetic linear ordering is equimorphic to a recursive one. On the way to our main result we prove that a linear ordering has Hausdorff rank less than $\omega _{1}^{\mathit{CK}}$ if and only if it is equimorphic to a recursive one. As a corollary of our proof we prove that, given a recursive ordinal α, the partial ordering of equimorphism types of linear orderings of (...) In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

We calculate the possible Scott ranks of countable models of Peano arithmetic. We show that no non-standard model can have Scott rank less than $\omega $ and that non-standard models of true arithmetic must have Scott rank greater than $\omega $. Other than that there are no restrictions. By giving a reduction via $\Delta ^{\mathrm {in}}_{1}$ bi-interpretability from the class of linear orderings to the canonical structural $\omega $ -jump of models of an arbitrary completion T of $\mathrm {PA}$ we (...) show that every countable ordinal $\alpha>\omega $ is realized as the Scott rank of a model of T. Most non-human animals live in the wild and it is probable that suffering predominates in their lives due to natural events. Humans may at some point be able to engage in paradise engineering, or the modification of nature and animal organisms themselves, to improve the well-being of wild animals. We may, in other words, make nature 'red in tooth and claw' no more. We argue that this creates a tension between environmental ethics and animal ethics which is likely insurmountable. First, (...) we argue that concern for the environment can be compatible with helping individual wild animals but should see redesigning nature as morally impermissible. Second, we argue that if we are concerned with animal well-being, we may reject that we have a duty to help wild animals even to the point of redesigning nature, but we must nevertheless concede that it is permissible to do so under certain circumstances. We show how this permissibility can be derived from three animal rights views: Tom Regan's, a novel account inspired by Thomas Pogge and a libertarian approach to animal rights. (shrink)

Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. I argue that once we understand the grounds that make freedom a desirable property (...) of choices, we can see how it is appropriate to predicate it of those made by any sentient agent. (shrink)

A menudo se asocia a Quine con los filósofos pragmatistas o al menos se le atribuye una posición consonante con el pragmatismo. En el presente ensayo examino la relación entre la obra de Quine y la de los pragmatistas clásicos: Peirce, James y Dewey. El recorrido por los escritos de Quine mostrará varias similitudes con la doctrina de los límites de la experiencia propuesta por James, y al mismo tiempo diferencias significativas con el naturalismo de Dewey y el pragmatismo de (...) Peirce. El balance de este recorrido es que aunque existen algunos elementos en común entre los pragmatistas clásicos y Quine,es imposible afirmar que haya existido un interés de parte de Quine de asumir como propias las tesis pragmatistas para desarrollarlas en direcciones novedosas. Wild animals probably have net negative lives. Christine Korsgaard rejects the view that we might engineer paradise by redesigning nature and animals so that they have the best possible existences. She believes the genetic changes required would not be identity-preserving, thereby causing animals to cease to exist. I argue, first, that paradise engineering is permissible. Many harms are caused by non-sentient natural entities and processes. Moreover, sentient animals can survive modifications compatible with their psychological persistence over time. Within the banking community, the argument about sustainability and profitability tends to be inversely related. Our research suggests this does not need to be strictly the case. We present a credit score system based on sustainability issues, which is used as criteria to improve financial institutions’ lending policies. The Sustainability Credit Score System is based on the analytic hierarchy process methodology. Its first implementation is on the agricultural industry in Brazil. Three different firm development paths are identified: business as usual, (...) sustainable business, and future sustainable business. The following six dimensions are present in the SCSS: economic growth, environmental protection, social progress, socio-economic development, eco-efficiency, and socio-environmental development. The results suggest that sustainability is not inversely related to profit either from a short- or long-term perspective. The SCSS is related to the Equator Principles, but its application is not driven to project financing. It also deals with short- and long-term risks and opportunities, instead of short-term sustainability impacts. (shrink)

Interest in ethical leadership from academics and practitioners has grown enormously in recent years. This article addresses this literature through a framework that identifies three interlocking questions. First, who are ethical leaders and what are their characteristics? Second, how do ethical leaders do what they do? Third, why do leaders do as they do and what are the outcomes of ethical leadership? Different dimensions to ethical leadership are examined and presented as three interlocking circles; Virtues, Purposes and Practices. On expectation, most wild animals have lives of net suffering due to naturogenic causes. Some have claimed that concern for their well-being gives us reasons to intervene in nature on their behalf. Against this, it has been said that many interventions to assist wild animals would be wrong, even if successful, because they would violate their freedom. According to the Freedom-based Approach I defend in this paper, this view is misguided. Concern for wild animal freedom does indeed gives us reasons (...) to secure these animals against control-undermining interferences, but also to intervene in nature in order to enrich their choices. Nonhuman animals are unable to exert any direct control over the functioning of democratic institutions –the decisions of which, nevertheless, have a pervasive impact on their lives. Their interests are therefore likelier to be set back or unfairly discounted, and their choices are more vulnerable to arbitrary interference. Because of this, some authors have suggested that we ought to redesign our political institutions so that they are more responsive to the interests of animals. We argue that this strategy fails to (...) address the root of the problem, which is animals’ lack of robust political agency. We defend that, should it become technologically feasible, we have a pro tanto obligation, derived from the values that underpin democracy, to uplift, or radically enhance, the political agency of nonhuman animals, so that they can better participate in mass democratic politics, express their interests as they see them, self-organise to defend them, and hold their representatives accountable. Finally, we explain how our argument manages to resist the most important objections against animal enhancement and, in some cases, it does so better than alternative proposals based on the value of animal well-being. En este artículo argumento sobre cuatro categorías diferentes de razones prácticas y las posibles combinaciones que admiten. Se explican apelando a las cuatro formas diferentes en las que la obtención de un estado de cosas puede ser valiosa. En primer lugar, explico la diferencia entre valores agencialmente-neutrales y agencialmente-relativos. En segundo lugar, distingo entre valores relativos-a-la-persona e impersonales. La combinación de estas categorías produce seis maneras posibles en las que la obtención de un estado de cosas puede ser valiosa -cuatro (...) básicas y dos derivadas.
